1. Purpose and Scope
This Marketplace Refunds, Disputes & Chargebacks Policy applies to purchases of digital products through the Amplivanta Marketplace. It supplements the Amplivanta Terms of Service and Marketplace Terms of Use.
2. Digital Product Refund Principle
Because digital files can be delivered or accessed immediately, purchases are generally final once access has been granted, except where this Policy, the product listing, payment-provider rules, or applicable law provides a refund or other remedy. CONSUMER RIGHTS PRESERVED Nothing in this Policy limits refund, cancellation, warranty, or statutory rights that cannot lawfully be waived.
3. Potentially Eligible Refund Situations
Amplivanta may approve or facilitate a refund when supported by available records and appropriate under the circumstances. Duplicate charge or duplicate purchase. The purchased files cannot be accessed because of a marketplace-side delivery failure that is not resolved within a reasonable support process. The product is materially different from the listing or materially incomplete. A file is corrupt, malicious, or unusable in the represented format and the issue cannot reasonably be corrected. An unauthorized transaction is established through applicable fraud or payment-provider procedures. Applicable law requires a refund or cancellation right.
4. Usually Ineligible Situations
Subject to mandatory law, a refund ordinarily is not granted solely because the buyer changed its mind, no longer needs the product, lacks required third-party software that was disclosed, expected a business result that was not promised, or used the product successfully and later decided not to keep it.
5. How to Request Review
The buyer should use the marketplace support flow associated with the order and provide the order identifier, product, issue description, and relevant evidence. Any request window shown at checkout or required by law controls; this draft does not impose an unsupported universal deadline.
6. Seller Participation in Disputes
Amplivanta may ask the seller to provide the listing version, product files, license terms, delivery information, update history, or other records relevant to a dispute. Seller must respond reasonably and accurately.
7. Resolution Options
Depending on the issue, the resolution may include troubleshooting, replacement files, corrected access, seller update, partial adjustment where supported, full refund, denial, or another remedy required by law or payment-provider rules.
8. Effect of a Refund
Unless law requires otherwise, a full refund ends the buyer's license to the refunded product. Download access may be removed, and the buyer must stop new use and delete source files reasonably within its control.
9. Chargebacks
A buyer retains the right to use lawful payment-card or payment-provider dispute processes. Where practical, contacting marketplace support first may allow faster resolution, but this Policy does not require a buyer to waive mandatory chargeback rights. Seller balances or payouts may be adjusted for valid chargebacks, reversals, or payment-provider fees as allowed by the Seller Agreement. Abusive, fraudulent, or repeated bad-faith chargebacks may result in marketplace restrictions.
10. Taxes, Fees and Currency
Refund treatment for taxes, processor charges, currency conversion, or other transaction components depends on applicable law, payment-provider rules, and the original transaction configuration.
11. Dispute Records and Privacy
Amplivanta may retain transaction, support, fraud, and dispute records as reasonably necessary for marketplace administration, security, accounting, legal compliance, and enforcement, subject to applicable privacy requirements.
12. Marketplace Decision and External Rights
Amplivanta may make marketplace-level decisions based on available evidence, but those decisions do not eliminate rights a party may have under applicable law, payment-provider rules, or a separate agreement.
13. Policy Changes and Contact
Material changes will be handled under the Amplivanta Terms of Service and applicable law. Support requests should use the in-product or Help Center flow; legal questions may be sent to legal@amplivanta.com. CONTACT Questions about this document may be sent to legal@amplivanta.com.
